Studio Sio Home Collections – Terms and Conditions

These Terms and Conditions (“Terms”) apply to the purchase of Studio Sio Home Collections (“Products”) from Studio Sio Limited (“Studio Sio”). By placing an order for a Product, the purchaser (“Customer”) agrees to be bound by these Terms. All goods and services supplied by Studio Sio are subject to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms limits or excludes the Customer’s rights under those Acts.

1. Definitions

In these Terms: “Customer” means the purchaser of a Product from Studio Sio. “Product” means any Studio Sio Home Collections box supplied by Studio Sio. “Studio Sio” means Studio Sio Limited. “Terms” means these Terms and Conditions.

2. Nature of Product

The Products comprise curated interior design concept boxes containing physical samples, printed materials, and supplier information. The Products are provided for general design guidance only and do not constitute site-specific advice, architectural services, or professional consultancy. Studio Sio does not warrant or represent that any particular outcome will be achieved from the use of the Product. Outcomes may vary depending on site conditions, application, workmanship, and installation.

3. Pricing and Payment

All prices are stated in New Zealand Dollars (NZD) and include GST unless stated otherwise. Payment in full is required at the time of purchase. Studio Sio is not obliged to process or dispatch any order until payment has been received in full. Studio Sio reserves the right to amend pricing at any time prior to acceptance of an order.

4. Delivery and Risk

Products are available for delivery within New Zealand only. Studio Sio will use reasonable endeavours to ensure that Products are packaged and dispatched with due care and within a reasonable timeframe. Delivery timeframes are estimates only and are not guaranteed. Studio Sio is not liable for any delay in delivery once a Product has been dispatched. Risk in the Product passes to the Customer upon delivery to the Customer’s nominated delivery address.

5. Returns and Remedies

Returns are not accepted for change of mind. If a Product does not comply with the guarantees under the Consumer Guarantees Act 1993, the Customer must notify Studio Sio within a reasonable time after delivery and provide evidence of the issue. Where required under the Consumer Guarantees Act 1993, Studio Sio will repair, replace, or refund the Product.

6. Product Variations and Availability

The Products contain representative samples only. Natural materials may vary in colour, texture, and finish. Supplier products and materials may change or become unavailable without notice. Studio Sio does not warrant the ongoing availability of any specific material, finish, or supplier.

7. Third Party Suppliers

Any supplier information or discount codes are provided for convenience only. Studio Sio is not responsible for any goods or services supplied by third parties, including pricing, availability, delivery, or performance.

8. Limitation of Liability

To the extent permitted by law, and subject to the Consumer Guarantees Act 1993, Studio Sio is not liable for any loss, damage, or cost arising from: (a) use or application of the Product;
(b) reliance on the design concepts provided;
(c) installation, construction, or workmanship; or
(d) any third party supplier, product, or service. Studio Sio’s total liability is limited to the purchase price of the Product.

9. Suitability and Compliance

The Customer is responsible for ensuring that all materials and finishes are suitable for their intended use and comply with all applicable laws, regulations, and building requirements.

10. Intellectual Property

All intellectual property in the Products, including design concepts, written material, and presentation, remains the property of Studio Sio. The Customer is granted a non-exclusive, non-transferable licence to use the Product for personal, residential purposes only. The Product must not be reproduced, distributed, or used for commercial purposes without the prior written consent of Studio Sio.

11. Governing Law

These Terms are governed by the laws of New Zealand.

12. Amendments

Studio Sio may amend these Terms from time to time. The Terms in force at the time of purchase apply to that purchase.
